6. International data transfers
Some of the recipients of your personal data are located outside your country or have offices in countries where data protection laws may provide a different level of protection than the laws in your country. When transmitting data to such recipients, we ensure appropriate guarantees.
6.1 Data transfers to members of BaumaScan GmbH
The transfer of personal data between different BaumaScan GmbH companies is based on our global data protection principles, which represent binding internal data protection regulations (Binding Corporate Rules, BCRs), or on the basis of other suitable guarantees (e.g. standard data protection clauses issued or approved by the EU Commission (2010/87/EU, 2001/497/EC or 2004/915/EC)). With the Binding Corporate Rules, the BaumaScan GmbH companies undertake to protect your personal data and comply with data protection obligations.
6.2 Other data transfers (from the European Economic Area to third countries)
We will only transfer your personal data from the European Economic Area (EEA) to third countries, i.e. countries outside the EEA, based on appropriate guarantees. Third countries that currently provide an adequate level of data protection include Andorra, Argentina, Canada (with regard to companies covered by the Personal Information Protection and Electronic Documents Act), Switzerland, the Faroe Islands, Guernsey, the State of Israel, the Isle of Man, Japan, Jersey, New Zealand and Uruguay. In other cases, BaumaScan GmbH provides the necessary guarantees, for example by concluding data protection contracts issued by the European Commission (e.g. standard data protection clauses (2010/87/EU, 2001/497/EC or 2004/915/EC)) with the recipients, or through other measures provided for by law.

Your personal data will be stored by us and our service providers in accordance with applicable data protection law to the extent and for as long as this is necessary for the processing purposes set out in this data protection declaration. We will then delete your personal data in accordance with our data retention and deletion policies or take steps to properly anonymize the data.
Something different applies if we are legally obliged to keep your personal data for a longer period (e.g. to fulfill legal obligations or for tax, accounting and auditing purposes). In Europe, retention periods are usually between 6 and 10 years (e.g. for contracts, communications and business letters). To the extent permitted or required by law, we restrict the processing of your data instead of deleting it (e.g. by blocking it). This applies in particular in cases where we may need the data in question for further contract processing or legal prosecution or legal defense, or where its storage is otherwise required or permitted by law. The relevant criterion for the duration of the restriction on processing is then the statutory limitation or retention periods. After the relevant statute of limitations or retention periods have expired, the data in question will be deleted. The specific retention periods for personal data are documented in our data retention policies. How long we retain personal data may vary depending on the services we offer and our legal obligations under applicable national law. The following factors typically influence storage duration:
• Necessity for the provision of our services This includes, for example, the implementation of the user agreement with you, maintaining and improving the performance of our services, maintaining the security of our systems and maintaining accurate business and financial documents. Most of our retention periods are determined based on this general rule.
• Special categories of personal data If it involves the storage of special categories of personal data (i.e. personal data revealing racial and ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, as well as the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, health data or data relating to the sex life or sexual orientation of a natural person), a shortened retention period is usually appropriate.
• Consent-based processing of personal data If we process personal data based on consent (including consent for extended storage), we will store the data for the period necessary to process your personal data in accordance with your consent.
• Legal, contractual or other similar obligations Corresponding retention obligations can arise, for example, from laws or official orders. It may also be necessary to store personal data in view of pending or future legal disputes. Personal data contained in contracts, communications and business letters may be subject to legal retention requirements depending on national law.
